The Women’s Fairness in Sports Bill passed the Senate in a vote of 20-15 and the bill is now sitting at Governor Noem’s desk awaiting her signature.

The bill would require that schools and athletic associations in South Dakota collect written waivers from each student identifying the sex that they were born with.

The ACLU in South Dakota strongly opposes the bill and Jett Jonelis, the advocacy manager, went before the South Dakota senate to testify.

“In an attempt to “level the playing field,” House Bill 1217 excludes an entire group of women and girls from meaningful participation in sports. “House Bill 1217 isn’t about protecting fairness in women’s sports. It’s about erasing and excluding trans people from participation in all aspects of public life.” – Jett Jonelis

Several other organizations in South Dakota joined the ACLU in opposition of the bill including the Sioux Falls Sports Authority, South Dakota Board of Regents, School Administrators of South Dakota, The Transformation Project and The South Dakota High School Activities Association.

South Dakota joins several other states that have passed similar bills banning transgender women from being able to compete in women’s sports.

Mississippi passed a similar bill several weeks ago as well banning men from competing in women’s sports.
